1. Agreement to Terms

By accessing and using the services provided by Akamai Legal Video ("Company", "we", "us", or "our") via akamailegalvideo.com, you are agreeing to be bound by these Terms and Conditions. If you do not agree with any of these terms, you are prohibited from using or accessing this site and our services. These terms apply to every booking. Submitting a booking request, or confirming a job by email, accepts them.

2. Services and Neutrality

Akamai Legal Video is a neutral, third-party legal videography and litigation support service. We do not provide legal advice. During depositions, our videographers will go on the record at the request of any attorney present, but will only stop recording upon the explicit agreement of all counsel present.

3. Scheduling, Minimums, and Cancellations

Deposition videography is subject to a standard four-hour minimum billing requirement. Any scheduled job that is canceled after 10:00 AM HST on the business day prior to the scheduled event will incur the full four-hour minimum charge, in addition to any logistical or travel expenses already incurred by Akamai Legal Video.

4. Travel and Expenses

Akamai Legal Video is based on Hawaiʻi Island. We do not charge travel fees for depositions on Hawaiʻi Island, and we do not bill travel time anywhere in the state. For services requiring travel to other islands, transportation, flights, and parking are billed at cost. When a morning start needs a night-before flight, the ordering firm pays for lodging. For inter-island travel, a per diem applies to cover meals and incidentals, as listed on our current rate sheet. Hawaiʻi General Excise Tax (GET) is added to all invoices.

5. Data Retention and Integrity

We use SHA-256 hashing to document the integrity and chain of custody of the legal record. We retain E01 forensic masters for seven years and notify clients before deleting them. Clients are responsible for keeping their own delivered copies of the media. Hash manifests are kept with the masters. Case files are deleted on the schedule the client sets, or after seven years if none is set. Delivery links expire after 60 days and are reissued on request.

6. Disclaimer of Warranties

Our services and website materials are provided on an "as is" basis. Akamai Legal Video makes no warranties, expressed or implied, regarding the outcome of litigation resulting from the use of our multimedia deliverables. We are not liable for technological failures outside of our reasonable control, though redundant backup systems are standard practice on all assignments. To the fullest extent permitted by law, our total liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim, and we are not liable for indirect, incidental, special, or consequential damages. This limit does not apply to gross negligence or willful misconduct.

7. Payment

The firm or agency that orders a service is responsible for payment, whether or not its client reimburses it. Invoices are sent after the job and are due on receipt. We accept check and ACH.

8. Travel Disruption

If a flight is cancelled or weather prevents travel, the ordering firm pays for extra hotel nights and rebooked travel.

9. Summaries and Analysis

Summaries, contradiction matrices, chronologies, interpreter audits, and search results are aids for attorney review, not legal advice. Verify them against the transcript and source documents before relying on them.

10. Governing Law

Any claim, dispute, or litigation relating to Akamai Legal Video's website or services shall be governed exclusively by the laws of the State of Hawaii, without regard to its conflict of law provisions.
