1. Agreement to Terms

By accessing and utilizing the services provided by Akamai Legal Video ("Company", "we", "us", or "our") via www.akamailegalvideo.com, you are agreeing to be bound by these Terms and Conditions. If you do not agree with any of these terms, you are prohibited from using or accessing this site and our services.

2. Services and Neutrality

Akamai Legal Video operates strictly as a neutral, third-party legal videography and litigation support service. We do not provide legal advice. During depositions, our videographers will go on the record at the request of any attorney present, but will only stop recording upon the explicit agreement of all counsel present.

3. Scheduling, Minimums, and Cancellations

All videography and litigation support services are subject to a standard four-hour minimum billing requirement. Any scheduled job that is canceled after 10:00 AM HST on the business day prior to the scheduled event will incur the full four-hour minimum charge, in addition to any logistical or travel expenses already incurred by Akamai Legal Video.

4. Travel and Expenses

Akamai Legal Video is based on the Big Island of Hawaii. We do not charge travel fees for local depositions. For services requiring travel to other Hawaiian islands, all transportation, flights, and parking are billed at cost. For inter-island travel, a standard $140 per diem applies to cover meals and incidentals.

5. Data Retention and Integrity

We utilize enterprise-grade cryptographic verification (SHA-256 digital hashing) to ensure the permanent integrity and chain of custody of the legal record. While we maintain a secure permanent archive of original files, clients are responsible for maintaining their own delivered copies of the media.

6. Disclaimer of Warranties

Our services and website materials are provided on an "as is" basis. Akamai Legal Video makes no warranties, expressed or implied, regarding the outcome of litigation resulting from the use of our multimedia deliverables. We are not liable for technological failures outside of our reasonable control, though redundant backup systems are standard practice on all assignments.

7. Governing Law

Any claim, dispute, or litigation relating to Akamai Legal Video's website or services shall be governed exclusively by the laws of the State of Hawaii, without regard to its conflict of law provisions.
